Permits and demolition in the City of Buffalo

A container on a private lot needs no City permit. On a City street or sidewalk, City Code § 413-4(C) requires a street-obstruction permit from the DPW Traffic Division (Room 512, City Hall, (716) 851-5366), applied for at least seven business days ahead with a $1,000,000 certificate of insurance naming the City and an MPT diagram. Leaving a box in the street without one is a Class J violation at $665, and every day counts as a separate offence.

Demolition itself is permitted through the Department of Permit and Inspection Services (online at epermits.buffalony.gov). The published fee is $300 to demolish a one- or two-family dwelling and $0.12 per square foot with a $500 minimum for a commercial structure, and demolition applications go to the Preservation Board for review. Demolition without a permit carries a $1,500 penalty. None of that is our paperwork, but we have watched enough jobs to tell you what to expect.

What goes in a construction dumpster

New York State treats construction and demolition debris as its own waste stream: concrete, brick, masonry, tile, wood including painted and treated lumber, drywall, plaster, roofing shingles, asphalt, window glass, carpet, metal pipe and wire. All of that is fine in our containers and goes to a permitted C&D transfer station such as Casella’s facility on Union Road in West Seneca.

Excluded by the state: friable asbestos, fluorescent ballasts and lamps, appliances, tires, fuel tanks and any container with more than an inch of residue. Suspect asbestos in an older Buffalo house? It has to be abated by a licensed contractor under New York’s Industrial Code Rule 56 before demolition.
